By purchasing a ticket and/or attending Wellington Malayalee Association (WMA) Ponnonam 2026 ("the Event"), you acknowledge that you have read, understood and agree to be bound by the following Terms & Conditions.

1. General

1.1 Tickets are issued by Wellington Malayalee Association (WMA) for Ponnonam 2026.

1.2 WMA reserves the right to amend these Terms & Conditions where reasonably necessary.

1.3 The purchase of a ticket constitutes acceptance of these Terms & Conditions.

2. Event Changes, Postponement or Cancellation

2.1 WMA reserves the right to cancel, postpone, reschedule, relocate or modify the Event, venue, programme, artists or event schedule due to circumstances beyond its reasonable control.

These circumstances include, but are not limited to:

• Natural disasters or severe weather

• Earthquakes

• Flooding

• Government restrictions

• Public health emergencies

• Flight cancellations or travel disruptions affecting artists, guests or key personnel

• Venue unavailability

• Technical failures or power outages

• Industrial action

• Transportation disruptions

• Any other unforeseen circumstances beyond WMA's reasonable control.

2.2 Should the Event be cancelled and WMA elect to issue refunds, any refund shall be strictly limited to the original ticket price paid by the purchaser.

2.3 WMA shall not be liable for any additional expenses, losses or damages suffered by attendees, including but not limited to:

• Travel costs

• Accommodation

• Parking

• Meals

• Booking fees

• Loss of income

• Any indirect, incidental or consequential losses.

3. Refund Policy

3.1 Tickets are generally non-refundable except where required by New Zealand law.

3.2 Refund requests arising from personal circumstances, including illness, inability to attend, travel delays, change of plans or change of mind, will not normally be accepted.

3.3 If the Event is postponed, tickets will remain valid for the rescheduled date unless otherwise advised by WMA.

4. Artist & Programme Changes

4.1 WMA will make every reasonable effort to present the advertised artists, performers, programme and schedule.

4.2 Circumstances beyond WMA's control may require changes to performers, programme content, performance order or event schedule.

4.3 WMA reserves the right to substitute performers, modify the programme or alter event timings without prior notice.

4.4 Changes to artists, programme or schedule shall not entitle ticket holders to any refund, compensation or reimbursement.

5. Sadya Session Attendance

5.1 Your ticket confirms your booking for the selected Sadya session only.

5.2 Attendees are expected to arrive sufficiently before the commencement of their allocated session.

5.3 If an attendee arrives after their allocated session has commenced or concluded, WMA cannot guarantee seating or meal availability within that session.

5.4 WMA will make every reasonable effort to accommodate late arrivals in another available Sadya session where capacity permits; however, this cannot be guaranteed and, where available, it may not be in the next immediate session.

5.5 No refund, compensation or alternative entitlement will be provided where an attendee misses their allocated Sadya session due to late arrival.

6. Tickets

6.1 A valid ticket is required for admission.

6.2 Tickets may be transferred to another person before the Event, provided the ticket has not already been used.

6.3 WMA reserves the right to request proof of identity where reasonably necessary.

6.4 Lost, stolen or damaged tickets may not be replaced.

7. Admission, Registration & Wristbands

7.1 All attendees must present a valid ticket at the registration desk upon arrival.

7.2 Tickets will be validated before entry.

7.3 Following validation, attendees will be issued with a colour-coded wristband corresponding to their allocated Sadya session.

7.4 Wristbands must be worn at all times while attending the Event.

7.5 Strictly no re-entry will be permitted without a valid WMA-issued wristband.

7.6 WMA reserves the right to inspect bags and personal belongings upon entry where reasonably necessary for the safety and security of attendees. Any prohibited or unsafe items may be refused entry into the venue.

7.7 Professional security personnel may be present throughout the Event to assist with crowd management and the safety of all attendees.

7.8 All attendees are expected to conduct themselves respectfully and responsibly towards volunteers, performers, venue staff, security personnel and fellow attendees.

7.9 WMA reserves the right to refuse admission or remove any attendee whose behaviour is considered:

• Unsafe

• Disruptive

• Abusive

• Violent

• Intoxicated

• Illegal

• Offensive

• Likely to interfere with the enjoyment or safety of others.

7.10 Any person refused entry or removed from the Event under this clause shall not be entitled to any refund, compensation or reimbursement.

8. Alcohol-Free Event

8.1 WMA Ponnonam 2026 is a strictly alcohol-free event.

8.2 Alcohol must not be brought into, consumed or distributed anywhere within the Event venue or surrounding Event areas.

8.3 Any attendee found possessing, consuming or distributing alcohol may be refused entry or removed from the Event without refund.

9. Photography & Media Consent

9.1 By attending the Event, attendees consent to photography, video recording and audio recording being undertaken during the Event.

9.2 WMA may use such recordings for:

• Website

• Social media

• Promotional material

• Future event marketing

• Community publications

• Media releases

9.3 No compensation will be payable for the use of such recordings.

10. Food & Allergies

10.1 While every reasonable effort will be made to provide accurate dietary information, WMA cannot guarantee that food served at the Event is free from allergens.

10.2 Attendees with allergies or dietary requirements consume food at their own risk.

11. Parking

11.1 Parking at or around the venue is the responsibility of individual attendees.

11.2 WMA does not provide supervised parking facilities and accepts no responsibility or liability for any loss, theft, damage or incidents involving vehicles parked at the venue, surrounding streets or nearby parking areas.

11.3 Attendees must comply with all venue parking instructions, local road rules and any directions provided by Event staff or security personnel.

11.4 Parking in any coned-off, reserved, emergency access or restricted areas is strictly prohibited. Vehicles parked in such areas may be reported to the appropriate authorities or requested to be moved immediately.

12. Children

Parents and guardians remain responsible for supervising their children at all times throughout the Event.

13. Personal Property

Attendees are responsible for their own personal belongings.

WMA accepts no responsibility for any lost, stolen or damaged personal property.

14. Health & Safety

All attendees agree to comply with reasonable directions issued by WMA volunteers, venue management, security personnel and emergency services to ensure the safe and orderly operation of the Event.

15. Limitation of Liability

To the maximum extent permitted by New Zealand law, WMA, its committee members, volunteers, sponsors, partners, contractors and representatives shall not be liable for any injury, death, loss, damage, expense or claim arising from attendance at or participation in the Event, except where such liability cannot legally be excluded.

16. Force Majeure

WMA shall not be liable for any failure or delay in performing its obligations due to events beyond its reasonable control, including but not limited to:

• Natural disasters

• Floods

• Earthquakes

• Severe weather

• Pandemics

• Government restrictions

• Industrial action

• War

• Civil unrest

• Terrorism

• Transportation disruptions

• Utility failures

• Any other force majeure event.

17. Privacy

Personal information collected during ticket purchases, registrations or event enquiries will be used solely for administering the Event and WMA activities in accordance with the Privacy Act 2020 (New Zealand).

18. Right to Refuse Admission and Service

Wellington Malayalee Association (WMA) reserves the right, at its sole discretion, to refuse ticket sales, refuse admission, or remove any person from the Event where it reasonably considers such action necessary to:

• Protect the safety, security and wellbeing of attendees, volunteers, performers and staff;

• Prevent disruptive, abusive, intoxicated, violent, unlawful or inappropriate behaviour;

• Protect Event property or venue facilities;

• Ensure the orderly and safe operation of the Event; or

• Enforce these Terms & Conditions or any applicable venue policies.

Any person refused entry or removed from the Event under this clause shall not be entitled to any refund, compensation or reimbursement.

19. Governing Law

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of New Zealand.

Any dispute arising out of or in connection with these Terms & Conditions or the Event shall be subject to the exclusive jurisdiction of the New Zealand courts.

20. Acceptance of Terms

By purchasing a ticket and/or attending Wellington Malayalee Association (WMA) Ponnonam 2026, you confirm that you have read, understood and agreed to these Terms & Conditions.
